ApexMP – Moto Products Terms and Conditions (T&C)
§ 1 Scope, Definitions
(1) Robin Draco, Falkenweg 8, 53343 Wachtberg, Germany (hereinafter referred to as “ApexMP – Moto Products” or “we”) operates the website https://apexmp.de An online store for motorcycle accessories. These Terms and Conditions apply to all orders placed by consumers or businesses through the online store.
(2) “Consumer,” as used in these Terms and Conditions, means any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. “Business entity” means any natural or legal person who, when entering into a legal transaction, is acting in the course of their commercial or self-employed professional activity.
§ 2 Conclusion of the Contract
(1) The product images in the online store are not binding. The contract is concluded as soon as the customer clicks the “Buy Now” button and confirms the order. The customer will receive an order confirmation via email immediately afterward.
(2) The order will be processed via email. Please make sure that the email address you provided is correct and that no spam filters are blocking it.
§ 3 Prices, Shipping Costs, and Payment Terms
(1) All prices are final and do not include sales tax in accordance with § 19 of the German Sales Tax Act (UStG) (small business exemption).
(2) Payment is due immediately upon conclusion of the contract. The following payment methods are available:

- Credit/Debit Card
- Apple Pay
- Google Pay
(3) Shipping costs are calculated based on the size and weight of the items and are displayed during the ordering process.
§ 4 Terms of Delivery
(1) The delivery time for items in stock is usually 2–3 business days. The customer will be notified immediately of any delays.
(2) We ship exclusively to the following countries: Belgium, Germany, Italy, Luxembourg, the Netherlands, Poland, Switzerland, Spain, and Austria.
§ 5 Right of Withdrawal
Consumers have the right to cancel the contract within 14 days without providing a reason. The cancellation period begins on the day the customer takes possession of the goods. § 6 Liability and Warranty
(1) We are fully liable for damages resulting from injury to life, body, or health that are caused by an intentional or negligent breach of duty on our part or on the part of our legal representatives.
(2) We are liable for other damages only in cases of intentional or grossly negligent breach of duty. In cases of slight negligence, we are liable only for breaches of material contractual obligations, and then only for foreseeable damages typical for this type of contract.
(3) Please note: Our motorcycle accessories are not approved for use on public roads and have not undergone TÜV certification or any other StVZO testing. They are intended exclusively for private use or use on racetracks. Use on public roads is at your own risk.
(4) Due to the manufacturing process, 3D-printed parts may exhibit minor visual variations. These may include small irregularities or surface imperfections, which, however, are only visible upon close inspection and in no way impair the product’s functionality. A certain degree of tolerance is permitted, and such variations do not constitute grounds for a complaint based solely on visual defects, provided that the product remains fully functional.
§ 7 Retention of Title
The goods remain our property until the purchase price has been paid in full.
§ 8 Shipping by Third Parties
(1) Some of the products we offer are shipped directly from the manufacturer or supplier to the customer. This may result in varying delivery times and shipping methods, which are displayed to the customer when placing an order.
(2) The customer acknowledges that for orders shipped by third parties, the goods may be shipped from non-EU countries, such as China, and therefore import duties, such as customs duties and import sales tax, may apply, which the customer is responsible for paying. These costs are not covered by ApexMP – Moto Products but must be paid directly to the delivery service.
(3) ApexMP – Moto Products acts solely as an intermediary for the order and assumes no responsibility for delays or complications arising from shipping by third-party providers.
§ 9 Final Provisions
(1) German law applies. The provisions of the United Nations Convention on Contracts for the International Sale of Goods do not apply.
(2) Should any provision of this contract be invalid, the validity of the remaining provisions shall remain unaffected.
